Summary Suit Called. Plaintiff Called present and his counsel is absent but his junior is present. The instant summary suit U/O XXXVII CPC is called. The plaintiff is present through his learned counsel, Mr. Imam Bux Khaskheli. On last hearing (25-07-2026), the plaintiff was directed to get published in Daily ???Kawish??? Newspaper, Hyderabad the summons for the appearance of defendant before this Court today (08-08-2026). In compliance, the learned counsel for plaintiff has submitted the published summons in said newspaper; however, defendant has not appeared. R & Ps reveal that before the publication of summons as a substitute mode of service, the summons had been issued on Form No.4 Appendix-B CPC, 1908 for service upon the defendant through all ordinary modes; however, he kept him out of the way for the purpose of avoiding service. It is now 02:30 am, the defendant is called absent and none has appeared for him. In consequence, the service against him stands held good. Put off to 22-08-2026 at 08:30AM for applying for the leave to defend the suit by the defendant. |
