He argued that defendants No.01, 02, 04 and 05 may be allowed to file power of attorney through defendant No.01 on behalf of other defendants. He therefore, prayed that order dated:08-09-2026 may be recalled and matter be reopened for only production power of attorney of legal heirs of defendant No.04 Abdul Kareem in favour of defendant No.01 Achar Khan. Heard and perused record reveals that on 08-09-2026 the evidence side of defendant was closed vide such statement filed by learned counsel for the defendants at Exh-134/- and thereafter, matter was fixed and adjourned to number of dates for final arguments. In this regard, learned counsel for plaintiff has already advanced his final arguments and matter is fixed today for Judgment with liberty to defendants side for meanwhile argument. The only reason for recalling the order of side close dated:08-09-2026 is for production of power of attorney which could not be filed by the defendant side during evidence. Not filing power of attorney during evidence of fault of defendant side. Defendant side cannot be allowed to fill their lacunas however, learned counsel for defendant is at liberty to file such power of attorney through statement and may highlighted during course of final arguments, if he desires so. Virtue of aforesaid position, instant application is hereby disposed of in above terms. Learned counsel for defendant No.01 produced special power of attorney on behalf of L.Rs of defendant No.04(a to c) & defendant No.05 through his statement at Ex:140. Order on it. File.
