Mr. Safdar Ali Charan, learned advocate for complainant per instruction the unconsumed sample has since beern collected, but the deputed officials are/is avoiding to take the same to Lahore lab under the guise that requisite permissions from Home Department Sindh through SSP is to be obtained it is so, it is against judicial order which was passed by this Court for the perpose. No such permission is required in existing of direction issued under judicial order and be complied with in letter and sprit without wasting further time. R&Ps received from the Court of Honourable Sessions Judge, Dadu, for its disposal according to law. Case called. Accused Khadim Hussain @ Kaloo Qambrani is present on bail. Learned ADPP for the State is present. Complainant namely Yar Muhammad Shahani is present. Mr. Safdar Ali Charan, learned advocate for complainant is present. Mr. Faheem Ghaloo, advocate is present and filed Vakalatnama on behalf of accused namely Khadim Hussain @ Kaloo Qambrani. Order passed on it. File. In compliance of section 265-C Cr.P.C. Case papers supplied to the accused vide receipt at Ex. 02. Complainant namely Yar Muhammad Shahani submitted application. Order passed on separate sheet. Such order was to be complied with, which the police has failed till date. Firstly, such official will go to Rohri laboratory and if found to be still lying, would collect same from the said laboratory and then will submit the same before Forensic lab Lahore (Punjab) for re-examination thereof for the purpose of detection of poison therein. And in case samples have been destroyed by the lab authorities, such certificate shall be obtained by him from lab authorities and be produced before this court by next date. And in case unconsumed samples are given to him same shall be got duly sealed from the lab officials and will submit the same before forensic lab Punjab at Lahore for the purpose of the detection of the poison if any in such samples and obtained such report therefrom and submitted the same before the court. The expenses shall be born by the complainant side. Copy of order and report of chemical lab be sent. Order accordingly. Case adjourned to 09-02-2026 for framing of charge/report. Present accused is directed to attend. |
