D.D.A is present. Today Judgment passed and announced in open court. The impugned judgment and decree dated 10/2/2021 is hereby set-aside and the underlying suit of plaintiff is hereby decreed in above terms and the Mukhtiarkar Shahdadpur is hereby appointed as commissioner to adjust the share of plaintiff in the remaining area of suit land in the possession of defendants, hand over possession thereof to plaintiff after partition and update revenue record accordingly. Appeal in hand allowed accordingly. It is noticed that as per the impugned Judgment and Decree dated 10/2/2021 the plaintiff had not supplied the requisite Court fees stamps of Rs.15000/- therefore the Learned Trial Court directed the plaintiff to deposit the Court fees in Government Treasury. It is also noticed that the appellant/plaintiff failed to supply the requisite Court fees stamps with the memo of this appeal. Therefore the appellant is directed to deposit aforesaid Court fees in the Government treasury within 50 days and produce such proof with the Reader/Nazir of this Court and in case of her failure the office is directed to bring such failure into the notice of this Court so that any proper order can be passed. The parties are saddled with to bear their own cost. |
