Learned ADPP and learned counsel for the complainant are present. It is evident from the record that the matter has remained pending for examination of witnesses since August 2024. The proceedings have been repeatedly delayed on one pretext or another, primarily due to the non-appearance of the accused persons. The record further reflects that detailed orders have previously been passed, containing multiple warnings to the accused and their learned counsel to ensure their appearance and to proceed with the matter, which has been pending since 2023. It is also apparent from the record that learned counsel for accused Riaz filed a bail application, which was allowed in May 2025. Since then, the proceedings have been unnecessarily prolonged, and delaying tactics appear to have been adopted by the counsel for the accused. Such conduct reflects contumacious disregard and non-compliance with the orders of this Court. The record further reveals that learned counsel for accused Muhammad Arif filed an application under Section 540-A Cr.P.C., contending that the accused could not appear due to the demise of certain family members caused by torrential rains and landslides in the province of Khyber Pakhtunkhwa, along with an application seeking condonation of absence in December 2025. However, the said application has remained pending, and the learned counsel has continued to file similar applications for condonation of absence on the same grounds for the past three months without furnishing any plausible justification. It is astonishing to note that today accused Riaz appeared in person; however, his learned counsel filed an application seeking condonation of his absence on the ground that his wife was hospitalized, rendering him unable to appear before the Court. The accused, being present in Court, denied any knowledge of such circumstances and stated that he was unaware of any such application having been filed on his behalf. Accordingly, the said application is dismissed. The learned counsel is directed to appear in person on the next date of hearing and explain his position regarding the apparent misstatement and concealment of facts. On the other hand, the application seeking condonation of absence of accused Muhammad Arif is also dismissed. The office is directed to issue Non-Bailable Warrants (NBWs) against accused Muhammad Arif. Furthermore, the application filed under Section 540-A Cr.P.C. on behalf of accused Muhammad Arif is dismissed, as the grounds stated therein are not sufficient to justify his continuous absence over the past three months merely on account of alleged losses due to torrential rains or the demise of relatives. Additionally, a cost of Rs. 5,000/- is imposed upon accused Muhammad Arif in favor of the complainant, who has been unnecessarily vexed and has suffered despite regularly appearing and complying with the orders of this Court, while the proceedings have been delayed due to the conduct of the accused. Let the matter be fixed for 23rd April 2026. The office is further directed to issue Non-Bailable Warrants (NBWs) against accused Muhammad Arif and Hussain Baloch. |
