Case called. Accused except accused Shahnawaz are present on bail. Learned ADPP is present. Heard; learned ADPP. Order passed and pronounced in open Court; Today the case is fixed for framing of charge. Perusal of the R & Ps sent up by the learned Civil Judge & J.M-I Hala shows that cognizance of Section 324 PPC was taken and R&Ps were sent up on the ground that offence punishable under section 324 PPC is exclusively triable by the Court of Sessions. Perusal of the police papers shows that in final medical certificate the injury is determined to be Ghayr-JaifahDamiyah, and Mutalahimah with further no traumatic bony lesion seen. Perusal of the medical certificate of injured Muhammad Khan further shows Old fracture of distal end of right fibula with no recent traumatic bony lesion seen. These nature of injuries as shown in the medicolegal certificates are punishable under section 337-A(i) PPC, which are triable by the Court of Judicial Magistrate. The record further shows that ingredients of Section 324 PPC are not attracted to this case. For the reasons discussed hereinabove the R & Ps of the above mentioned case is hereby transferred to learned Civil Judge & Judicial Magistrate-I Hala to try and proceed with the case in accordance with the law. Put of to.22.12.2025. Present accused are directed to attend transferee Court on next date of hearing. |
