As per record, since many dates of hearing, the matter was at the stage of hearing on the point of maintainability. The counsel for the plaintiff submitted that this Court had already dismissed the Application Under Order 7 Rule 11 CPC while deciding the question of maintainability. He also submitted a copy of order dated 09.04.2026 passed in Constitutional Petition No.S-762/2025 and contended that the issue with regard to the counter-claim is to be framed and the matter should be decided after recording evidence of the parties. On the other hand, the counsel for the defendant No.1, during his arguments on the point of maintainability, contended that the suit of the plaintiff is not maintainable, as the plaintiff has come before this Court for the declaration of his title on the basis of his sale agreement. In this regard, he placed reliance upon 2000 SCMR 204, 2017 SCMR 367 and 2019 YLR 1548. Let the matter be fixed for the orders on the point of maintainability on the next date ???.
