The matter is called. Plaintiff of the subsequent suit and his counsel are present. Defendants and their counsel remain absent on repeated calls. Witness Muhammad Waqas is present, who stated that plaintiff Muhammad Kashif is ill and has gone to Hyderabad. The second witness is also absent. Perusal of record reveals that issues were framed on 25.01.2023, and consolidated issues were framed on 01.02.2023. Since then, the matter has been fixed for the evidence of the plaintiff of the leading suit. Record further shows that the plaintiff of the leading suit, Muhammad Kashif, was examined on 09.08.2023 as per case diary. It also appears that this Court dismissed the suit vide judgment dated 06.03.2023, which was subsequently set aside by the learned Appellate Court through judgment dated 07.08.2024. Perusal of the case diary further reflects that witnesses Muhammad Waqas and Sumair were examined on 09.10.2024. Cross-examination of plaintiff Muhammad Kashif was partly conducted on 26.04.2025, whereafter his further cross-examination was reserved. However, from that date till today after passing 13th dates the plaintiff and his witnesses have failed to appear and proceed with their evidence. Despite repeated indulgence, including a specific last opportunity granted vide order dated 19.04.2025, the plaintiff has shown no interest in pursuing the matter. In view of the above conduct, it is evident that the plaintiff of the leading suit is not interested in prosecuting his evidence and has deliberately lingered on proceedings. Hence, the chief examination of the plaintiff and his witnesses of the leading suit are hereby discarded. Put up for defendant side evidence. Put off to 27.08.2025 for evidence of defendant. |
