Case called. Accused are present on bail. ADPP is present, this case would amount to double jeopardy, which is infraction of Article 12 of the Constitution and Section 403 of Cr. PC, it is deemed apt that proceedings of the case be stopped under section 249-Cr.PC without announcing acquittal or conviction. Therefore, as a small solace, accused Daud, Muhammad Khan, Zahid and Muhammad Mureed are released, wisdom borrowed from the case of Mst. Safdar Bibi vs. The state, (PLD 1990 Karachi 233 and Khizir Hayat vs. The state(2010 PCr.LJ 1400) surety(s) is discharged. However, accused are directed to appear before this court as and when called by this Court, in the event of failure, law will take its own course. Order accordingly. With these observations, the application stands allowed.
