Accused Meer Hassan s/o Jatoi @ Bashir Ahmed, by caste Lolai is hereby convicted u/s 265-H(ii) Cr.P.C, for committing murder of deceased Gulsher (since dead Gulsher had received 06 fire arm injureis at the hands of 05 accused including present accused Meer Hassan and out of 06, three injuries were suficient to cause death in ordinary course of nature and prosecution could not distinguished that injuryh caused by present accused Meer Hassan was out of three injuries which were sufficient to cause death in ordinary course of nature or otherwise, therefore, treating it mitigating circumstances), he (Meer Hassan) is sentenced under section 302 (b) PPC as Tazir's to suffer rigorous imprisonment for life and to pay fine of Rs.500,000/- (five lac) as compensation for disbursement among LRs of deceased (Gulsher) as required u/s 544-A Cr.P.C and in case of default he will suffer R.I for 06 months more. The accused Meer Hassan is also convicted under section 265-H(ii) Cr.P.C for committing murder of deceased Noor Hassan and he is sentenced under section 302 (b) PPC r/w section 149 PPC as Tazi'r to suffer rigorous imprisonment for life and to pay fine of Rs.500,000/- (five lac) as compensation for disbursement among LRs of deceased (Noor Hassan) as required u/s 544-A Cr.P.C and in case of default he will suffer R.I for 6 months more. Benefit of section 382 (b) Cr.P.C is extended to convict Meer Hassan. Record reveals that convict was arrested on:27.08.2020 in instant case. The conviction awarded to convict shall run concurrently. He is present in custody and remanded back to jail alongwith conviction warrant and slip to serve out the sentence awarded to him. The copy of instant judgment be supplied to convict Meer Hassan Lolai, free of costs. Copy of such judgment supplied to the convict Meer Hassan and receipt obtained from him and kept on record.
