Sessions case called. Accused (1) Moriyo son of Manthar Shar is produced in custody, while accused (2) Basheer son of Peeral Shar as per case diary maintained by magistrate shown in custody, but today he appeared and claimed that he has been released on bail. While other accused (3) Hakim son of Karam Shar (3) Sono son of Manthar (4) Ghafoor alias Abdul Ghafoor Shar are absconding and declared as proclaimed offender. The ADPP Mr Ashfaque Ahmed Kalwar for the state is present. Mr Abdul Sattar Malano advocate has filed his vakalatnama on behalf of present accused persons which is taken on record. Charge against present accused u/s 265-D Cr.P.C framed (Exh 5) Pleas of accused under section 265-E Cr.P.C recorded (Exh 5/A & Exh 5/B). In terms of section 265-F Cr.P.C PW-1 ASI Ali Nawaz Tunio, PW-2 HC-259 Abdul Ghaffar, PW-3 PC-2297 Naseer Ahmed PW-4 PC-1059 Khuda Bux, PW-5 PC-3945 Asif Ali, PW-6 alleged abductee Akhtar Ali Lakhan and PW-7 Khan Hassan Bhutto are present and examined (Exh 06 to Exh 12). The alleged abductee Akhtar Ali has submitted an application with affidavit for adopting same evidence as of his evidence on behalf of other abductee Koural son of Meer Muhammad which is taken on record (Exh 12/A). The ADPP for the state has submitted statement for closing the side (Exh 13). The statement of present accused persons under section 342 Cr.P.C recorded (Exh 14 and Exh 15). The final arguments heard. Judgment passed on separate sheet (Exh 16) and announced. The present accused Morio son of Manthar Shar and Basheer son of Peeral Shar are acquitted of the charge in terms of section 265-H(i) Cr.P.C. Accused Morio is produced in custody and remanded back to custody along with acquittal slip for his release in this case, while the bail bonds of accused Basheer are cancelled and surety discharged. However, case against the absconding accused/proclaimed offenders be kept on dormant file. however perpetual warrants against them be issued. Hg:29.8.2026. |
