Sessions case called. Accused (1) Abdul Ghani is absent under intimation filed by co-accused. Accused (2)Raheem (3)Bego (4) Abbas (5) Muhammad Qasim (6) Ali Sher and (7) Saleh are present on bail. While accused Achar son of Ghulam Haider Gabole is absconding and already declared as proclaimed offender. The complainant, his counsel Mr Ali Raza Kalwar and Mr Saeed Ahmed Chachar counsel for accused are present. Mr. Saeed Ahmed Chachar has filed his vakalatnama on behalf of Qasim and Abbass, which is taken on record. The complainant Khudadad Gabole examined Ehx.17. His counsel has submitted statement for closing the side (Exh 18). The complainant has filed an application with affidavit for vacating the possession of land and handing over the same to him which is taken on record (Exh 19). The accused also submitted an application with their respective affidavits for delivering of possession after measurement, which is taken record (Exh20). Final arguments heard. Judgment passed on separate sheet (Exh 21). ?? Consequently, present accused named above stand acquitted in terms of section 265-H(i) Cr.P.C. They are present on bail hence their bail bonds are cancelled and surety discharged. Let copy of this Judgment be communicated to Deputy Commissioner Ghotki at Mirpur Mathelo with direction to ensure measurement, demarcation,?? Nishandahi and delivery of peaceful possession of entire land as per revenue record out of S.No.06 to complainant through his concerned sub-ordinate officers and officials obviously after hearing and in presence of all khatedars of adjoining land in order to end this controversy forever subject to law and Land Revenue Act under compliance report within a month. Copy of this Judgment be also communicated to SHO Khanpur Mahar to provide required legal assistance to the concerned team in this regard in order to avoid any breach of peace subject to law.
