I have heard Advocate for the Plaintiff and have perused the Commissioner Report dated 27.11.2025 including contents of memo of plaint, preliminary decree and commissioner report. From the record it is reflecting that the Plaintiff has wrongly mentioned the specification of suit property as Plot of Land bearing No.L-53, Sector 5-A/1, New Karachi, Karachi, ad-measuring 80 square yards alongwith 02 Shop No.31 & 32 constructed therein allegedly left by deceased Muhammad Miskeen. However, the site inspection report of the Commissioner dated 27.11.2025 clearly reveals that the suit property viz. L-53, Sector 5-A/1, New Karachi, Karachi, is consisted of only ground plus one residential house, whereas the 02 Shop No.31 & 32 are constructed on separate/adjacent area bearing Commercial Plot No.LS-573, Sector 5-A/1, New Karachi, Karachi, hence, the subject shops are not the part and parcel of suit property and cannot be sold out through preliminary decree. Therefore, the Nazir of the Court is directed to call fresh valuation report of the suit property viz. House No.L-53, Sector 5-A/1, New Karachi, Karachi, which is constructed only ground plus one residential house. However, the Plaintiff side is at liberty to avail proper remedy regarding subject shops constructed on Pot No.LS-573, Sector 5-A/1, New Karachi, Karachi. Put off to 04.03.2026 for compliance. |
