Case is called. Accused Mashghool and Muhammad Ibrahim are called absent without any intimation. While accused Ali Gul is absconder and already declared as P.O. Mr.Gahi Khan Bangwar, learned ADPP for the State is present. Mr.Saeed Ahmed Bangwar Advocate for accused and surety namely Shahmurad Chachar is present. Process viz.proclamation u/s 87, Cr.P.C issued against both the absent accused named above returned by the SHO concerned with the compliance of Court directions. In this respect, statement of HC Taj Muhammad recorded at Ext.7. He produce original proclamation u/s 87, Cr.P.C, letter of SHO, mashirnama of proclamation, publication, and relevant DD entries at Ext.7/A to 7/F respectively. Report of warrant u/s 88, Cr.P.C also received by this Court from Mukhtiarkar concerned, at Ext.8, stating therein that there is no any moveable or immoveable property in the name of absconding accused Mashghool and Muhammad Ibrahim. PW/ASI Noor Ahmed Chachar and HC Taj Muhammad are also present. Surety of both the absent accused Mashghool and Muhammad Ibrahim namely Shah Nawaz Chachar is present. Reply of notice u/s 514, Cr.P.C filed by the surety Shahnawaz, supported with his affidavit. Order on it. Arguments heard from both the sides. Order also passed, signed and announced in open Court. For the reasons to be recorded, the application is hereby dismissed. Since, this Court had given the custody of accused Mashghool and Muhammad Ibrahim in the hand of surety named above with directions to ensure the attendance of the accused before this Court on each and every date and since the surety named above failed to discharge his duty, therefore, bail bond of surety is hereby forfeited in favour of government. A penalty equivalent to 100% of the surety bond amount is hereby imposed upon surety named above. Office is directed to en-cash and the relevant DSCs furnished by the surety and deposit the recovered amount under the appropriate government head without fail. Case property is produced. Case proceeded. D/O HC Taj Muhammad recorded u/s 512, Cr.P.C at Ext.9. He produce relevant DD entries and FIR at Ext.9/A & 9/B. D/O ASI Noor Muhammad Chachar also recorded u/s 512, Cr.P.C at Ext.10. He produce relevant DD entries, mashirnama of injuries of injured ad police referral letter to the concerned MLoO at Ext.10/A to 10/C respectively. Case Put off to:03-08-2026, for evidence u/s 512, Cr.P.C. Issue summons against complainant Sher Dil, P.Ws Muhammad Ishaque, Mst.Gulzadi, Muhammad Hassan, WMO Sakeena and I.O/SIP Hazoor Bux Mahar. Office is directed to en-cash the DSCs furnished by the surety Shah Nawaz Chachar on behalf of accused Mashghool and Muhammad Ibrahim and deposit the recovered amount under the appropriate government head without fail. |
