Sessions case called. Accused (1) Yaseen s/o Lalan Shar (2) Akbar s/o Lalan Shar are produced in custody through video link. Accused (3) Saeed Khan s/o Anwar Shar is present on bail. Proceedings against accused (4) Hakim alias Hakoo son of Muhammad Nawaz Shar already abated on accounts of his death. While accused (5)Qaim son of Peeral Shar and (6) Jeewan son of Dil Murad Shar are absconding and already declared as proclaimed offender. The I/C ADPP and DC are present. Case papers supplied. Prosecution in terms of section 265-F Cr.P.C got examined Complaiant ASI Gul Muhammad Siyal (Exh???06), eye witness-mashir PC Aijaz Ahmed Naich (Exh???07) and PC Khuda Bux Malahn (Exh???08) and documents produced by them are taken on record. The learned ADPP for State therefore in terms of section 265-G Cr.P.C closed evidence side vide statement (Exh-09) hence statements of present accused have been recorded at Exh-10 to 12 in terms of section 342 Cr.P.C. Final arguments heard. Judgmenet passed on separate sheet (Exh 13) and announced. Accused (1) Yaseen s/o Lalan Shar (2) Akbar s/o Lalan Shar and (3) Saeed Khan s/o Anwar Shar acquitted of charge in terms of section 265-H (i) Cr.P.C by extending benefit of doubt. Accused Saeed Khan Shar is present on bail, his bail bond stands cancelled and surety discharged. Co-accused Yaseen Shar and Akbar Shar who have been produced through video link so let acquittal intimation for their rlease in this case only be issued to the concerned officer District Prison Ghotki. However, case against proclaimed offenders be kept on dormant file till their arrest or otherwise and perpetual warrants be also issued for 8.10.2026. |
