Statement of ASI Toufique Shah I/C SHO of P.S Jhabir Shaikh has been recorded at Ex-19, he produced documents at Ex-19-A to Ex-19-H. Learned ADPP for the state has filed statement for keeping the case in abeyance at Ex-20. Heard. Learned ADPP and DCs. Order passed on separate sheet and announced in open court, on account of non-attendance of complainant and PWs, accused can not be subjected to agony of dates, particularly when complainant and PWs are not willing to proceed with the case. Hence, keeping forth the above position, I hereby order that this sessions case be kept in abeyance against accused namely; Dost Muhammad s/o Miandad, Abdul Karim s/o Arbab Ali, Ghulam Muhammad s/o Haji Muhammad Pathan and Muhammad Ameen s/o Miandad, all by caste Abro are present on bail. Surety already submitted by them shall be bound dow the period of three years. They are also directed to furnish PR bond in the like amount for attending the Court for trial, if and when called. Prosecution side is at liberty to apply for re-opening of the case after availability of complainant and private witnesses. While passing their order reliance was respectfully place on reported case of SIP Saeed Ahmed Shaikh and others v/s Muhammad Bakhsh and another ( SBLR 2015 Sindh 948).
