Order passed on separate sheet & announced in open court. As Per Order. By this order, I intend to dispose of application the adjournment application filed by learned counsel for defendant. Matter per diaries is fixed for defendant evidence/ cross-examination. Arguments on pending application. Perusal reveals that ground mentioned in present application is that defendant has gone out of city, said ground seems to be meritless. It is pertinent to mention here that on previous date an adjournment application filed by learned counsel for defendant on similar ground was also granted with direction to defendant side to proceed with the matter, to produce witnesses till next date (Today) failing which any appropriate order shall be passed. Despite of allowing his previous application with such clear directions, the defendant side has again moved similar application on similar ground instead of proceeding with the matter which is not worth appreciating rather compels the court for passing adverse order nevertheless, this court has again moving restraint and adjourn the matter in the interest of Justice with direction to defendant side to produce witnesses/ proceed with the matter till next date as last and final chance, failing which any appropriate order shall be passed.
