Case called. Accused Taseel @ Tehseel jumped the bail and declared as P.O. While remaining accused are absconders and have already declared as P.Os. Learned DDPP for the State is present. Process viz.proclamation warrant u/s 87, Cr.P.C issued against accused Taseel @ Tehseel Sundrani return by the SHO concerned with the compliance of court directions. In this respect, statement of HC Akbar Ali Nindwani recorded at Ext.11. He produce noticed issued by this court u/s 87/88, Cr.P.C, mashirnama of publication, published notice and letter of SHO at Ext.11/A to 11/F respectively. Report of warrant u/s 88, Cr.P.C also received by this court from Mukhtiarkar concerned, vide No.SM/2474/2023, stating therein that there is no any moveable or immoveable property in the name of above named accused. It is admitted position that surety of accused Taseel @ Tehseel Sundrani namely Abdul Razzaque Sundrani, has failed to attend the court on issuance of notice u/s 514, Cr.P.C by this court for his appearance, hence the presence surety has violated the personal bond as well as terms and conditions of of surety, as he was directed to ensure the attendance of the accused named above before this court on each and every date of hearing but he failed to do so. Hence, the presence surety is liable to pay full surety amount. In view of above position, the bail bond furnished by the surety named above, is forfeited to the extent of 100% of the surety amount i.e 200,000/- (two lac). The DSCs furnished by the above named surety in the sum of Rs. 200,000/- (two lac), be en-cashed and same amount be deposited in relevant head of account of Government exchequer in accordance with law. Thereafter, side close statement submitted by learned DDPP at Ext.13. Order passed on it. File. Heard. Order also passed, signed and announced in open court at Ext.14. For the reasons to be recorded. The proceeding against above named accused be kept on dormant file, till his arrest. Office is directed to issue perpetual warrant of arrest/NBWs against absconding accused.
