Sessions case called. Accused (1) Subhan @ Tedi @ Subhan Ali is produced in custody, accused (2) Dilmurad @ Diloon and (3) Sadam Hussain are present on bail as per last case diaries. While accused (4) Waris son of Luqman Ptiafi (5) Rahib son of Allahyar Gabole and (6) Baboo son of Faqeer Muhammad Pitafi are are absconding and already declared as proclaimed offenders. The ADPP & Mr Irshad Ali Soomro advocate for accused are present. Documents supplied to accused against receipt (Exh3). Charge framed charge against them (Exh 4/A) to which they denied, pleaded not guilty and claimed trial vide pleas in terms of section 265-E Cr.P.C (Exh 4/A to 4/C). Prosecution in terms of section 265-F Cr.P.C got examined Complaiant HC/11 Ghulam Mustafa Soomro (Exh???05), eye witness-mashir PC/3696 Ghulam Murtaza (Exh???06) and I.O SIP Aijaz Ali Gadani (Exh???07) and documents produced by them are taken on record. The learned ADPP for State therefore in terms of section 265-G Cr.P.C closed evidence side vide statement (Exh-08) hence statement of present accused have been recorded at Exh-09 to 11 in terms of section 342 Cr.P.C wherein he denied prosecution evidence but neither opted to state on oath in terms of section 340 (2) Cr.P.C nor opted to produce any Defense witness. Final arguments heard. Judgment passed on separate sheet (Exh 12) and announced. Consequently, I feel no hesitation to acquit the present accused named above of charge in terms of section 265-H (i) Cr.P.C by extending benefit of doubt. Accused Subhan urif Tedi urif Subhan Ali Pitafi, who has been produced uncder custody is hereby remanded back to District Prison Ghotki for his release in this case forther with if he is no more required in another case/crime. Co-accused Saddam Hussain and Dil Murad are present on bail, hence their bail bonds cancelled and surety discharged. However, case against proclaimed offenders be kept on dormant file till their arrest or otherwise and perpetual warrants be also issued.
