28-01-2026. Matter called. This suit is main leading suit consolidated with New FC Suit No.02/2026 (old suit No:104/2020) which is returned back from SCJ-II Mps. The plaintiff is called absent. Learned counsel for plaintiff is present. The attorney of defendant No.01 is present. Learned counsel for the plaintiff and defendant appeared and filed separate statements at Ex:94 & Ex:95. Order passed & announced in open court. As Per Order. Matter per diaries it fixed for order on application U/o 09 rule 07 read with section 151 C.P.C and hearing of final arguments. The said application was disposed off today on separate order. While, with regard to final arguments, learned counsels for respective sides filed aforesaid separate statements by stating therein that they have no objection if the issues are to be re-casted and framed separately in present suit owing to the fact that the consolidated suit bearing NO:104/2020 was transferred to the court of learned 2nd Senior Civil Judge, Mirpurkhas upon administrative ground vide such order passed by Honourable District Judge, Mirpurkhas. They further contended that after re-casting the issues they adopt all the proceedings in the present suit already made and have no objection if the matter is to be fixed for final arguments/ proceedings when it was fixed at the time when the said consolidated suit was withdrawn/ transferred to the said court. The learned counsel for the plaintiff also consented and adopted verbally all the proceedings/ evidence already recorded in consolidated suits. The record reveals that issues in the present suit were framed on 28-01-2019. Subsequently, suit No:104/2020 was consolidated with present suit and such consolidated issues were framed on 24-10-2023. After that, evidence of plaintiff side was recorded and matter was repeatedly fixed for evidence of defendant side but due to failure of defendant side to get record their evidence, their evidence side was closed SUO MOTU by the court vide order dated:19-08-2025. Further, the said consolidated suit was again transferred back to this court and it has already been disposed off as withdrawn upon own application of plaintiff side in the suit No:104/2020 (new suit No:02/2026). Looking to the aforesaid position, statements of learned counsels for respective sides and their arguments issues are here by re-casted and framed separately at Ex:96. As the learned counsels for respective sides adopted the evidence and proceedings already recorded; therefore, let the matter be fixed for final arguments. Needles, to say here that the application U/o 09 rule 07 C.P.C was already fixed for order which has been passed today and the said application is disposed off being dismissed on separate order. As such, matter is adjourned 02-02-2026 for final arguments. Learned counsels for respective sides are directed to advance their final arguments till next date. |
