Case called. Accused Asif Shoro has already been declared as absconder vide this court order dated. 09.03.2024. Proclamation U/s 87 Cr.P.C has been issued against him to ASI Wazeeruddin Panhwar. Same has been returned duly executed. Statement of ASI Wazeeruddin of PS Railway Kotri is recorded at ---------------------------------------------- Exh.04. He produced his report, Original Proclamation Notice U/s 87 Cr.P.C., copy of entry of concerned PS, copy of Publication and statement of two witnesses at ----- Exh.04/A to 04/F. I.O. ASI Wazeeruddin also submitted compliance report U/s 88 Cr.P.C duly issued from the Mukhtiarkar concerned which is R & R at Exh.08. Notice U/s 514 Cr.P.C issued against the surety namely Mst.Rukhsana is also returned un-served as per report of ASI Wazeeruddin. Such statement of ASI Wazeeruddin is also recorded at ----------------------------------------------------------------------------------------- Exh.05. He produced original un-served notice U/s 517 Cr.P.C, his report and copy of entry kept at Police Station Latifabad at Exh.09/A to 09/C. Since the surety of accused is avoiding service, and being satisfied that accused has jumped on bail the surety amount i.e. Rs:50,000/- is forfeited. Order passed accordingly. Since it has been come on record that the accused is not traceable and the proceeding U/s 87 & 88 Cr.P.C. have been carried out therefore, the case against the accused Asif Shoro S/o Wadero Jamal Shoro is kept on dormant file till his arrest. However, in compliance of directions contained in the order dated 17.05.2023 passed by the Honorable High Court of Sindh Karachi vide letter NO. 1062/MIT-II/crl.Misc Appln No.284.2018 Dated 06.06.2023 passed in PLD 2016 Sindh 238. IO and SSP are directed to submit report for arrest of absconding accused on quarterly basis, without fail.
