Case called. Accused Muslim Siyal is present on bail along with his counsel. ADPP is present. On last date of hearing, the IO was directed to produce the complainant and witnesses today for recording their evidence. Before this, various processes had been issued, but had been returned by the process servers with report that complainant and witnesses had shifted to unknown places. Today, the IO has also submitted the same report while returning the process. His statement was recorded along with his evidence also at Exh.14. He produced various documents at Exh.14/A to 14/J. The evidence of complainant had been recorded during the earlier round of litigation at Exh.7. In his evidence, he had not deposed against present accused as well as co-accused Hizbullah Siyal, who was acquitted in the earlier round. In spite of providing several opportunities, prosecution could not produce complainant and witnesses of incident due to their shifting to unknown place; such various reports of process servers and statement on oath of IO along with record of inquiry conducted by him is on record. Therefore, the evidence of complainant recorded during earlier round of litigation was considered relevant in this subsequent proceeding, and the side of prosecution was closed. Statement of accused under Section 342 Cr. PC was recorded at Exh.15. Final arguments were heard from both prosecution and defense side and then judgment was pronounced in open Court, whereby present accused Muslim Siyal was acquitted under Section 265-H (1) Cr. PC under the role of consistency as co-accused Hizbullah was also acquitted on the same set of evidence in first round of litigation.
