Case called. Accused namely Akhtar son of Manthar Jafferi is involved in this case. Since he has already been declared proclaimed offender. The attendance of accused could not be procured even after issuance of NBWs against him and after due codal formalities in terms of section 87/88 Cr.P.C have been initiated and was declared as proclaimed offender. ??Later-on, the prosecution was called upon to lead its evidence against accused in their absence in terms of section 512 Cr.P.C. However, prosecution has examined P.W-1 complainant H.C Ashique Ali Shaikh at Exh-04. Thereafter learned DDPP filed statement at Exh-05, wherein stated that case of accused be kept on dormant file till appearance of accused. Thus, this Court has left with no option except to keep the present case on dormant file, till arrest of the absconding accused named above. ??However case be fixed quarterly and NBWs be issued against absconders accused.?? |
