Matter called. Learned counsel for the plaintiff is present. None is present from defendants side. The present suit has been received by way of transfer from the Honourable High Court of Sindh after the amendment made in Sindh Civil Court Act (Sindh Civil Court Amended Act, 2025). Perusal of contents of plaint and its prayer clauses, the plaintiff has filed the instant suit for Declaration, Permanent Injunction and Recovery of amount of Rs.1,016,787,554/- alongwith Mark-up liquidated Damages and Cost against the defendants. Record shows that neither any of the defendants is residing or carry business within the jurisdiction of District Court Malir nor the cause of action shown in the plaint is accrued within the jurisdiction of District Court Malir. Moreover, the plaintiff has shown cause of action allegedly accrued at the office of the plaintiff which is situated at 48-J/1, Block-6 PECH Society Karachi and such address also does not fall within the jurisdiction of District Court Malir. Therefore, let the reference be made to the Honourable High Court of Sindh for appropriate order. Order passed on separate sheet. Put off to 21.08.2025 for further order.
