Deposition of PW Shahzado is recorded at Ex. 05 he produced documents at Ex. 05/A to 05/H. Despite the directions to the prosecution to procure attendance of witness, as last chance, failing which the side of prosecution will be closed and statement of accused will be record, neither the witness attended court nor any intimation from prosecution. Almost all the material witnesses already examined. Matter pertains to the juvenile trial. but despite issuance of again and again summons warrants and last chances to prosecution, even directions to prosecution that in case of failure to attend court, the side of the prosecution will be closed. Following the law laid down in 1970 P.Cr.L.J. 649 Lahore (The State??? V/s.. Jagmal Singh and four others) and 1977 P.Cr.L.J. 461 Lahore (Mansab Ali v/s.. The State). I, therefore, close the side of prosecution with liberty that in case of appearance of remaining witnesses (I.O and H.C.), he will be examined first thereafter statement of accused will be recorded.
