Matter called same is fixed for compliance of order passed by this court on 21.10.2025 as well as submission of Nazir report in respect of preliminary decree passed by Honourable High Court on 07.02.2025 in respect of one undisputed property i.e. Open Residential plot No. 77, Type-C, Admeasuring 600 Sq. Yds, In Block-A, Sector 11, Situated at Gulshan e Mehran Scheme 33, Super Highway, Karachi but till date compliance of this preliminary decree has not been executed due to the delaying tactics at the hands of plaintiff. Further record reflects issues were framed vide order passed by the Honourable High Court on 25.02.2025 in respect of one disputed property i.e House Constructed on residential Plot No. 8, Row No. 9, Sub-Block C, Block No. V, (V-C 9/8), Consisting of ground plus 02 storied, admeasuring 216 sq. Yds, situated at Nazimabad, Karachi and the commissioner was appointed to record the evidence in respect of this disputed property and fees of commissioner was fixed on Rs. 25,000/- per witness and one Mr. Saeed Ahmed Memon learned advocate was appointed as commissioner, but the commissioner report submitted by said learned counsel on 18.08.2025 that parties are reluctant to lead their evidence. As per record this is suit for Declaration, Cancellation, Mandatory Injunction, Administration and Permanent Injunction which is pertaining to the year 2017 and only learned counsel for defendant is appearing regularly and have submitted that the defendant No. 2 & 3 are actual / Lawful owner of disputed property i.e. House Constructed on residential Plot No. 8, Row No. 9, Sub-Block C, Block No. V, (V-C 9/8), Consisting of ground plus 02 storied, admeasuring 216 sq. Yds, situated at Nazimabad, Karachi vide Mutation No. CDGK / KDA / Land / ND / 07 / 304 dated: 12.07.2007 and they are enjoying the possession of disputed property. The plaintiff have no evidence in respect of this disputed property hence he is deliberately avoiding to appear before the court and record his deposition since framing of issue dated: 25.02.2025 and matter is being prolonged since 2017 till date. Therefore, in the light of above captioned discussions the suit of plaintiff is hereby dismissed U/o 17 rule 3 in respect of disputed property i.e. House Constructed on residential Plot No. 8, Row No. 9, Sub-Block C, Block No. V, (V-C 9/8), Consisting of ground plus 02 storied, admeasuring 216 sq. Yds, situated at Nazimabad, Karachi on the ground plaintiff of this case was communicated by the office of this court on his given cell number but it of no use and the counsel of plaintiff is also reluctant to appear and lead his evidence. In present circumstances further adjournment is futile exercise hence suit is dismissed to the extent of disputed property.
