Prosecution has examined mashir/ Saleemullah & investigation officer/ SIP Badar Uz Zaman were examined at Exh.3 & 4 respectively. Today i.e. 20.11.2025 case is fixed for evidence and at this stage accused Muhammad Sarfaraz son of Abdul Qadir produced by the jail authorities and also moved separate application whereby he pleaded guilty and prayed for leniency & mercy at Exh.5. 6?????????????????? Upon such applications, show cause notice was ordered u/s 265-E (2) Cr.P.C, which was issued to accused at Exh.6. Upon which accused has submitted his reply at Exh.7 wherein he stated that due to mistake he has committed this offence and prayed that he is doing labor to earn his livelihood, therefore, prayed for mercy & leniency. 7.???????????????? I have also heard accused in person and learned ADPP for state who has raised no objection. 8.???????????????? Accused Muhammad Sarfaraz son of Abdul Qadir is first offender and repented to repeat the offence. It is hard fact of life that poverty leads person to the world of crimes in order to earn bread and butter for his/her families. It appears that accused is now firm not to commit same offence again. The way the accused has owned his guilt voluntarily without any fear & pressure and surrendered himself at the mercy of this Court. It is also envisaged by Islam that ???Adl and Ihsan??? must be done. 9.???????????????? In view of above discussion, since the prosecution has established that accused Muhammad Sarfaraz son of Abdul Qadir has committed the offence, therefore, he is liable to be convicted. Admittedly, the prosecution has not been able to produce his previous criminal record; therefore, he deserve some leniency. In this regard I have taken guidance from case laws reported as 2009 Lahore page No.362 Para-10 Ghulam Murtaza v.s State and PLD 2017 SC 671 state V/s. Mujahid Naseem Lodhi. 10.???????????? Accordingly, I while exercising powers so conferred upon me under section 265-E (ii) Cr.P.C, and by taking lenient view convict accused Muhammad Sarfaraz son of Abdul Qadir for offence u/s 6/9 (2) (a) CNS Amended Act 2022 and sentenced to R.I for the period of Eleven Months Fifteen days and pay fine of Rs.3000/- (Rupees Three Thousand Only) in case of default, he shall suffer 15 days more Simple imprisonment. Accused is entitled for the benefit of Section 382-B Cr.P.C for the period which he remained in jail custody. Accused produced by jail authority. He remanded back to jail authorities to serve out the above sentence alongwith conviction warrant.???? However; case against co-accused Shoaib Qureshi son of Shahid Qureshi be proceeded in accordance with law. Case is adjourned to 18.12.2025 for evidence and issue BWs against witnesses |
