Sessions Case called. Accused (1) Zameer son of Illahi Bux Jageerani and (2) Ayoub son of Ali Hassan Jageerani are produced in custody. Accused (3) Akram Ali son of Muhammad Hayat (4) Farman son of Khabar (5) Hameer son of Illahi Bux (6) Zaheer son of Ali (7) Irfan son of Rehzan (8) Umed Ali son of Noorali (9) Momin son of Illahi Bux (10) Nisar son of Qabil and (11) Punnah son of Gul Hassan all by caste Jageerani are absconding and declared as proclaimed offenders. The ADPP for the State and Mr. Haseebullah Lakho advocate for present accused persons are present. PW-01 eye witness Sahib Lolai, PW-02 HC Sikandar Ali, PW-03 deceased Peer Bux's son Nabi Bux (Exh 06 to Exh 8). The eye witness Sahib Ali has submitted an application with affidavit for non examining remaining witnesses (Exh 9). The ADPP for the State has submitted statement for closing the side (Exh 10). The statement under section 342 Cr.P.C of accused recorded (Exh 11). Final arguments heard. Judgment passed on separate sheet (Exh 12) and announced. Accused (1) Zameer son of Illahi Bux Jageerani and (2) Ayoub son of Ali Hassan Jageerani are acquitted under section 265-H(i) Cr.P.C. Consequently, I feel no hesitation to acquit the present accused named above of charge in terms of section 265-H (i) Cr.P.C by extending benefit of doubt. Both present accused are hereby remanded along with acquittal intimation for their release in this case only by concerned officer District Prison Ghotki subject to law and Prison Rules. However, case against proclaimed offenders be kept on dormant file till their arrest or otherwise and perpetual warrants be also issued. Hearing 30.9.2026 |
