Matter called. Learned counsel for plaintiff and for defendant are present. However, Plaintiff and defendant are called absent. Separate order passed on order sheet. Record reveals that on 30.5.2025, the defendant was debarred from the right of cross-examination; therefore, the mater was adjourned ???for evidence of defendant???s side???. Record further reveals that due to human err, in a previous diary dated 23.8.2025, it was wrongly mentioned the stage of suit as ???for plaintiff side??? evidence, actually it would have been for ???evidence of defendant side???, therefore, it is corrected that matter is at stage of evidence of defendant side. An application u/s 151 CPC is filed, today, by the learned counsel for defendant to recall the order dated 30.6.2025, where the defendant was debarred from the right of cross-examination of plaintiff and his witnesses. The copy of this application is supplied to the learned counsel for plaintiff. He received a copy and submitted to have straightforward and direct argument on this application, without filing the objection in writing. A separate application u/s 151 CPC is also filed by advocate for defendant to administer the oath of defendant on above said application through a video link since he is ailing at home. Arguments heard on both said applications. Matter stands adjourned for orders on the instant applications, as well as, for defendant side evidence. Put of on 13.09.2025. |
