The present accused 1) Muhammad Shareef S/o Sultan?? 2) Shabir S/o Ahmed Lund?? & 3) Ghulam Nabi S/o Taj Muhammad??are hereby acquitted under section 265-H(1) Cr.P.C of the offence for which they charged. Accused are present on bail their bail bonds stand cancelled and sureties discharged. So far as the alleged absconding accused Sameer is concerned, the allegations against him are similar to those against the co-accused. It is stated in the FIR that he was present at the scene and gave kicks and fist blows to the deceased after he had been shot by Shahid Hussain. However, there is no claim or evidence that he used the danda he was carrying, nor did he fire any weapon or otherwise cause the fatal injury. Since the prosecution has failed to establish any direct role of Sameer in the commission of the murder, the case against him is weak. In the absence of reliable and legally admissible evidence implicating him, he is entitled to the benefit of doubt and is accordingly acquitted in absentia. Similarly, there is no justification to keep the case against him on a dormant file; therefore, he is also acquitted in absentia by extending the same benefit of doubt, in view of case law reported 2025 SCMR 1633 Re- GHULAM MUSTAFA alias Raja Buledi Versus The STATE. Let the such intimation be sent to the SHO concerned for deletion of the name of accused namely Sameer S/o Ghulam Ali by caste Lund?? from the list of proclaimed offender under intimation to this Court. However, case against absconding co-accused Shahid Hussain S/o Ghulam Nabi by caste Lund shall remain on dormant file as already ordered and concerned police shall continue to submit progress report on.05.05.2026.
