BA is called. The learned ADPP for the State, learned DC and complainant in person are present. DC filed two statements which are taken on record. Argument heard. Order passed and announced., The present applicant through the learned counsel sought post arrest bail in terms of section 497 Cr.P.C, which is hereby gratned subject to furnishing solvent surety in the sum of Rs.3,00,000/- ??and P.R bond in the equivalent amount. for legal justification that undeniably FIR dated:08-12-2025 does not contain name or face features of an unknown accused allegedly armed with a pistol, who also did not cause any harm to any of deceased persons or P.Ws but complainant along with witnesses through further statements dated:?? 16-6-2026 after inordainte delay of around six months surfaced name of present accused with reason that they went to a Dargah and saw present accused whome few women (identity not disclosed in further statement) were calling him as Hazoor Bux s/o Jan Muhammad Gadani, final report has been submitted and present accused having been inside Prison since June-2026 is no more required for invdestigation purpose, no incriminating material has been recovered from him thus he isno more required for investigation purpose and on court query complainant disclosed that present applicant???s sister was married to his husband Nari Gadani???s cousin, which means that he being caste fellow and relative due to his sister???s marriage with a male member of complainant family was already known to complainant and the alleged eye witness so his introduction as a co-accused under the attending circumstances is suspicious and makes case of further enquiry in terms of section 497 (2) Cr.P.C. Moreover, further-supplimentary statement as per dictum laid down by Honourable Superior Court is neither equivalent to FIR nor part thereof but such practice is usually adopted by police for ulterior motives at the sweet will of complainant |
