Case called. Accused Ghulam Yasin @ Yasin and Abdul Rahman are present on bail. While, accused Habib, Abdul Ghafoor, Ghulam Muhammad and Abdul Ghanir are still absconders and not yet served. ADPP and D.C are present. Process viz. 87 Cr.P.C against absconding accused returned unserved. Statement of process server is recorded at Ex.02, he produced relevant documents at Ex.02/A to 02/D respectively. Attachment u/s:88 Cr.P.C is also received from concerned Mukhtiarkar. Order on it, kept on record at Ex.03. Order passed on separate sheet at Ex.04, all the absconding accused are declared as POs. Section 395 PPC is exclusively triable by the court of sessions.
