Bail before arrest called. Applicant/ accused is called absent. Learned counsel for the applicant/ accused is also absent, learned ADPP for the state is present.???????????????????????????????????? Perusal of record shows that accused was granted ad interim bail before arrest vide order dated 29.08.2026 subject to furnishing surety in sum of Rs.1,00,000/- (Rupees One Lac Only), however, applicant/accused ha failed to furnish surety, it is now 02:00 PM. The relief of bail before arrest is an extraordinary relief which cannot be granted/extended in absence of accused.???????????????? Accused persons were required to be present on time, but he remained absent. Therefore, interim bail granted to applicant/ accused vide order dated 29.08.2026 stands recalled and, instant pre-arrest bail application stands dismissed for non-prosecution and for want of surety. |
