Case called. Accused Wadero Islam Khan Mahar and his learned counsel called absent. DDPP for State is present. One Chairman Mazari moved application for excusing absence of accused on the ground that accused is admitted in Hospital at Rahimyar Khan. His application for excusing of absence of accused is accepted. On last date of hearing also accused remained absent under intimation. Case file shows that on merits pre-arrest bail of accused Wadero Islam Khan was dismissed by the Court of learned Additional Sessions Judge-I, Mirpur Mathelo vide order dated 13.5.2025. After that accused neither surrenderred before Court nor applied for pre-arrest bail before Honourable High Court of Sindh. However, he repeated his bail application before same Court of learned Additional Sessions Judge-I, Mirpur Mathelo, where from he was admitted on ad-interim pre-arrest bail, despite of the fact that his bail plea was declined by same Court. Be that as it may, since Court of law had admitted accused on ad-interim pre-arrest bail, which is fixed for its confirmation or otherwise, therefore, in the interest of Justice case in hand is also transferred to the Court of learned Additional Sessions Judge-I, Mirpur Mathelo for deciding it in accordance with law.
