I intent to dispose of instant adjournment application moved by learned counsel for the plaintiff which was not objected by learned counsel for the private defendants. The record reveals that the examination in chief of plaintiff and his witness was recorded long ago but their cross-examination was reserved due to absence of counsel for defendant No:01. Since then, the matter is being repeatedly fixed and adjourned to several dates for cross-examination of the plaintiff and his witnesses but perusal of record reveals that sometimes the plaintiff side remains absent and sometimes the defendant side used to moved frequent adjournments applications. Today, matter was called since morning but neither the plaintiff and his witness, nor his counsel were present so also learned counsel for the private defendant No:01 was also called absent except his junior associate. Later on, at about 11:45 A.M the plaintiff side sent instant adjournment application on the ground of illness of plaintiff and Junior associate of learned counsel of the private defendant put his no objection on it. No supporting medical document been annexed with the present application to justify the illness ground of plaintiff. The record reveals that on last date the plaintiff and defendant side adopted same practice as the plaintiff side moved adjournment application which was not objected by defendant side; however, such adjournment application was granted, in the interest of justice and last and final chance extended to defendant side for conducting cross-examination to the plaintiff and his witness. But today, the plaintiff side itself remained absent and did not bother to appear in the court. It appears that both the plaintiff and defendant side are in league by moving adjournment application with no objection of defendant side. Such conduct could not be tolerated in future and the same is not worth appreciating. Record reveals that matter has been repeatedly adjourned and fixed to number of dates for cross-examination of plaintiff and his witnesses but the same has not been conducted due to default of other side. Nevertheless, instant application is hereby granted. As no medical document been annexed with present application to show that plaintiff is really ill or not thus cost of Rs.1,000/- is hereby imposed on plaintiff with direction to deposit the same till next date before Nazir of this court and the same shall thereon be deposited in District Court Dispensary on proper receipt. Looking through the lethargic conduct of both sides it is hereby clearly directed to both sides to appear and proceed with the matter till next date failing which any adverse order shall be passed against the defaulting party being very last and final chance. Matter adjourned to 31-01-2026 at 09:00 A.M. sharp, for cross-examination of plaintiff and his witness & also deposit costs of Rs.2000/-on next date of hearing. |
