Mr.Gahi Khan Bangwar, learned ADPP for the State is present. Complainant and private P.Ws are called absent. Mr.Saeed Ahmed B.Bijarani, learned advocate of complainant is present and submitted application for keeping the instant in dormant file till the arrest of accused on the ground that complainant and private P.Ws apprehends danger of their life, as accused persons have recently committed murder of his nephew at Sukkur. Order on it. Notice to State counsel, such notice waived by ADPP at Ext.08 and closed the side of prosecution, vide his statement at Ext.09. Order on it. Filed. Heard. Order also passed, signed and announced in open Court at Ext.10. For the reasons to be recorded, the proceeding against absconding accused persons be kept on dormant file, till their arrest. Meanwhile, the proceeding against them be continued in the light of case reported as Nasrullah Versus Station House Officer, Police Station, Jacobabad and 06 others (PLD 2016 Sindh 238) wherein a complete mechanism and guideline has been provided for proceeding further in such situation. The NBWs as well as proclamation u/s 87/88, Cr.P.C have already been initiated against the absconding accused persons which will remain effective in the future, till their arrest. |
