Matter called. The learned Counsel for Plaintiff is present. Advocate for the defendant No.1 (ii,iii,iv) are also present and re-argument heard. Presently the matter is fixed for service against Defendants for having fresh address as mentioned in statement filed by Defendant No.1(i). Upon perusal of the record, it transpires that Service was held to be good upon all the defendants on 28.04.2022 and upon Defendant No.2 on 28.03.2023. On 29.09.2022, learned counsel for Defendant No.1(i) filed a written statement on behalf of Defendant No.1(i). Defendants No.3 to 7 were debarred by the Hon???ble High Court of Sindh on 20.12.2022, while Defendant No.2 was debarred on 30.05.2023, whereafter the matter proceeded ex parte. On 30.11.2023 Matter was fixed for ex-parte Defendant Nos.3 to 7. Learned Counsel for Defendant No.1 filed written statement and stated that according to his knowledge Defendant No.2 has been expired and addresses of other Defendants as mentioned in the plaint are incorrect. Therefore Defendant No.1 filed a statement in which fresh addresses were mentioned on 06.12.2023. The R&Ps of the case were received by this Court on 01.03.2025 in compliance with Notification No.Gaz/XVI-A-127. On 22.05.2025 learned Counsel for Plaintiff was present, none is present from other side, Court motion notices issued against the Defendants on fresh addresses of Defendants filed by Defendant No.1(i). On 30.07.2025 learned Counsel for Plaintiff and learned Counsel for Defendant No.1 (i) were present and matter was fixed for hearing on under O.XXXIX Rule 1 and 2 CPC R/W 151 CPC, thereafter arguments heard by both sides on 30.09.2025 and matter was fixed for further hearing on under O.XXXIX Rule 1 and 2 CPC Therefore, service held good all the Defendants as Court motions notices were issued against the Defendants. Now the matter is fixed 19.02.2026 for Order on Under O.XXXIX Rule 1 and 2 CPC and plaintiff advocate served on service except on defendant No.(i) and filing of proposed issues.
