Judgment passed and announced in open Court that the appeal is dismissed with costs, and the Judgment and decree dated:20.08.2026 passed by the learned Senior Civil Judge, Kandhkot, in FC suit No.46/2026 are affirmed. The appellant shall hand over vacant an peaceful possession of Government Quarter No.3 Block Civil Hospital, Kandhkot, in accordance with the decree and through lawful process, failing which respondent No.1/plaintiff may seek its execution in accordance with law. The appellant shall further pay Rs.10,000/- to respondent No.1/plaintiff as costs of this appeal under section 35 CPC, recoverable in accordance with law. The official defendants shall faciliate implementation of decree strictly in accordance with law. The office is directed to prepare decree and send a copy of this Judgment to the learned trial Court for information alongwith R&Ps. |
