Case called. Today matter is fixed for hearing on execution application. The learned counsel for the decree holder called in attendance and advanced his arguments however none appeared from the side of the judgment debtor though matter has been called thrice with reasonable intervals. The gist of the application is that on 23.09.2025 the judgment debtor was debarred from filing objections against the instant execution whereafter the execution was fixed for hearing. Record reveals that vide Judgment dated: 22.01.2025, decree dated: 22.01.2025 the suit of the plaintiff decreed in his favour followed by the filing of execution application to which no any objection was filed from the side of judgment debtor nor any plausible excuse has been assign in respect of their nonappearance irrespective of the fact that the matter was also fixed for hearing on his application. It is matter of record that on 27.10.2025 this Court was intimated through statement that Civil Appeal preferred against the judgment was dismissed vide Order dated: 16.10.2025. Be that as it may, this Court has no option but to accept as true the version of the Decree Holder. For the foregoing reasons, execution application is allowed. The Decree Holder is directed to file Schedule of movable and immovable properties in order to recover the amount of decree. Matter put off to 09.12.2025 for compliance. |
