??05 th September declared Holiday and case called today i.e 08.09.2025 . Case called. All accused are present except accused Muhammad Khan and Abdul Hadi who are called absent without intimation. Learned ADPP for State is in attendance. Observing continuous disappearance of accused on one and other hearing, this Court is constrained not to??further tolerate absence of any accused, hence order to issue N.B.Ws against both absentee accused. Call their surety papers. Office is strictly directed to ensure compliance. Accused Muhammad Khan and Abdul Hadi remained absent on previous date of hearing, submitted their excuse application. One Mr. Hussain Ahmed Gadani, Advocate, filed Vakalatnama on their behalf. Order thereon. Accused Abdul Hadi has produced receipt of Pir Abdul Qadir Shah Jeelani Institute of Medical Sciences, Gambat, dated 03.09.2025 but he couldn???t explain the circumstances which suddenly came in his mind to remain absent and attend the hospital on date of hearing. Co-accused Muhammad Khan Gadani has produced medical record, stating that his daughter-in-law is admitted in PNS Shiffa Hospital, Karachi, but the prescription lacks name of any hospital. In attending circumstances, absence of accused is not currently exempted, further they have been provided opportunity to prove that their absence was not deliberate and are accordingly directed to produce previous medical record of Abdul Hadi and accused Muhammad Khan is directed to produce substantial record of his daughter-in-law along with proof. In case of failure, both accused shall be bound to produce fresh solvent surety in the sum of Rs.10,000/- and in case of failure to submit they shall be remanded against submission of surety.
