Judgment passed and announced in open Court at Ex.28 that accused Piyaro son of Sirajuddin and Barkat son of Kirrir both by caste Sabzoi are convicted u/s 265 H(ii) Cr.PC for the offense punishable u/s 337A(i) and 337F(i) PPC and sentenced to Simple Imprisonment for one year and to pay Rs.15,000/- (fifteen thousands) as Daman to be paid by accused Piyaro to injured Ghulam Nabi so also Rs.15000/- as Daman to be paid by accused Barkat to legal heirs of deceased (Sain Bux) as he (accused) Barkat caused lathi blow to deceased on his right hand elbow, and in case of failure they shall under go S.I for six months as Tazir. The accused Piyaro as well as Barkat are also convicted for the offense punishable u/s 452 PPC for the period of five years as simple imprisonment. All the convictions and sentences awarded to accused shall run concurrent. The benefit of section 382-B Cr.PC is allowed to the convict accused and the period for which they have remained in custody in this case shall be computed towards sentence. Accused Piyaro and Barkat both by caste Sabzoi are present on bail and they taken into custody, they remanded to Central Prison Sukkur to serve the sentence along with conviction warrants. The copy of Judgment handed over to the accused free of cost and such receipt obtained from them at Ex.29. The accused Khawand Bux is acquitted u/s 265 H(1) Cr.PC, he is present on bail,his bail bond stands cancelled and surety discharged.
