In continuation of earlier order passed by this court dated: 12.05.2026, today heard defendant No. 1 / Khalid Ahmed Khan and his sister named Humaira Naz / defendant No. 5 they called present in person along with their counsel. The learned counsel for the auction purchaser along with auction purchaser named Zulfiqar-ul-Haq is also present and submitted that at present his no claim is outstanding against the seller / co-sharer of subject shop and he is enjoying its possession since he purchased it. After hearing to defendant No. 1 & 5 who are surviving legal heirs of deceased Abdul Muqeet Khan and Shamim Fatima through their counsel, wherein they have prayed by filing separate application along with death certificates and FRC of deceased defendant No. 2, 3 & 4 that necessary direction may kindly be issue to the Nazir concerned with aim to release the share of their deceased siblings in their favor as per law and shariah the names of deceased legal heirs are i.e. Musharraf Ahmed Khan, Parveen Akhter and Asifa Parveen, who were died on respective dates issueless. Now, defendant No. 1 & 2 are only surviving legal heirs and plaintiff No. 1 has also been expired, but defendant No. 1 & 5 have not furnished the death certificate and FRC of plaintiff No. 1 / Muzaffar Ahmed Khan and none called present today from plaintiffs side no intimation has been received. Further it is absent in the record regarding the detail of amount / sale proceeds lying in their good office of Honourable Nazir of Honourable High Court, who have collected yet their share in subject sale proceeds at what extent. Therefore, the Honourable focal person named Arif is hereby directed to provide detail of share of deceased legal heirs i.e. Musharraf Ahmed Khan, Parveen Akhter and Asifa Parveen. The Judgment & Decree of the court and Nazir report which he submitted already are attached herewith for ready reference.
