Accused Shahbaz Ali & Zulfiqar are convicted U/s: 265-H (ii) Cr.P.C and sentenced to death as Tazir in terms of section 302 (b) PPC R/W Section 149 PPC with direction that he each convict be individually hanged by his neck till he is dead subject to confirmation by the Honourable High Court of Sindh, Circuit Court Larkana as well as to compensate the LRs of the bereaved family to the tune of RS.50,00,000/- (RS. Five million in equal share) in terms of section 344-A Cr.P.C. In case of failure convict at fault shall undergo S.I for six months and the compensation amount be also recovered from him as land revenue arrears as per law and they are also sentenced for offence U/S 148 R/W Section 149 PPC (Rioting being armed) with R.I for 03 years (each convict) and to pay fine of RS.50000/- in equal share and in case of failure convict at fault will also undergo S.I for three months. However, case against the proclaimed offenders be kept on dormant file till their arrest or otherwise and life time warrants be also issued. Copy of this judgment supplied to convicts individually today free of cost under proper receipt at Ex. No. 28, in terms of section 371 Cr.P.C with information that either of them may prefer appeal, if any within seven days of this judgment and a copy thereof be communicated to the learned DPP, Shikarpur. Moreover, proceedings of this case be also respectfully submitted before the Honourable High Court of Sindh, Circuit Court Larkana for confirmation in terms of section 374 Cr.P.C. The convicts who have been produced under custody from District Prison Shikarpur are hereby remanded back having conviction warrant and slip under police custody in order to serve out sentence as per law. |
