Since the prosecution has failed to prove the motive which is one of mitigating circumstances, therefore, this court while taking lenient view convict accused Muhammad Zeeshan S/O Muhammad Hussain Arain U/S 265-H (ii) Cr.P.C and sentenced to suffer life imprisonment for the offence of qatl-i-amd U/S 302(b) PPC as Ta???zir and to pay Rs. 500,000/- (Rupees five lac only) as compensation to the legal heirs of deceased U/S 544-A Cr.P.C which is to be recovered from accused as arrears of land Revenue. In case of default, he shall suffer six months more rigors imprisonment. The benefit of section 382-B Cr.P.C is extended to accused. The accused Muhammad Zeeshan is produced through video link, as he is confined in Central Prison Mirpurkhas and conviction warrant is to be sent to jail authorities for accused Muhammad Zeeshan to serve out his sentence awarded to him according to law. The accused persons namely Muhammad Asif S/O Muhammad Rafique Arain, Muhammad Jameel S/O Arzi Noohani and Mst. Shahida Parveen W/O Muhammad Hussain Arain are acquitted U/S 265-H (i) Cr.P.C by extending benefit of doubt. The case against proclaimed offender Ali Raza has already been kept on dormant file; his file will be re-opened as and when produced or appear. |
