The record reflects that the case file has been received from the Court of learned Judge Anti-Terrorism Court, Ghotki @ Mirpur Mathelo, whoe vide his order dated 21.07.2026, while deciding an application u/s 23 ATA, observed that the case pertains to the ordinary jurisdiction. The record reveals that earlier the Honourable High Court of Sindh was pleased to transfer this case from Sessions Court to the Anti-Terrorism Court, Ghotki under Criminal transfer application No.S-65/1996 vide order dated 14.03.202 and Civil petition filed before Honourable Supreme Court of Pakistan was not pressed with observation to file application u/s 23 of ATA before learned Judge of Anti-Terrorism Court, Ghotki. Record further shows that an application was filed before the Anti-Terrorism Court, Ghotki @ Mirpur Mathelo was dismissed vide order dated 16.01.2019, which was subsequently impugned before Honourable High Court of Sindh, Bench at Sukkur in C.P No.D-114/2019 and the same was declined vide order dated 24.01.2019, as such, the case has been proceeded before Anti-Terrorism Court, Ghotki @ Mirpur Mathelo. Yet again the same Court has passed an order dated 21.07.2026 with the observation that the case is required to be proceeded wih Sessions Court. In these premises, learned counsel for State as well as accused are hereby put on notice to satisfy this Court as why a reference may not be sent to the Honourable High Court for further proceedings in the matter since the order passed by the learned Judge of Anti-Terrorism Court, Ghotki is against the earlier directions of the Honourable High Court of Sindh, Bench at Sukkur.
