Perusal of record reveals that matter is fixed for further arguments. This court passed Judgment dated: 31-07-2023 and decree dated:07-08-2023 in which a consolidated Judgment was passed and the F.C Suit No:171/2017 was dismissed while F.C Suit No:02/2017 was decreed. The appellants Mann and others challenged the said consolidated Judgment by filing Civil Appeal No:105/2023 before Honourable Appellate Court and the said Civil Appeal later on allowed. Consequently, the aforesaid consolidated Judgment and decree were set-aside, the matter was remanded with direction to provide opportunity to defendants to examine marginal witnesses of agreement dated:20-10-2005 and afford proper opportunity to appellant to cross-examine them and to record fresh findings and Judgment in accordance with law, vide said Judgment dated:13-11-2025. The said Judgment was put before the undersigned and order was passed on it, ???Seen. Let matter be restored and fixed for evidence of marginal witnesses of defendant in respect of agreement dated:20-10-2005.??? As such both the consolidated suits should ought to have been fixed for same purpose but the F.C Suit No:02/2017 was escaped to be restored and fixed as per directions by the office to due to oversight. Accordingly, the office/ reader is directed to fix the said consolidated suit today with leading suit for the stage of further arguments. Learned counsel for the plaintiff in leading suit consented to the above position/ order sheet.
