Criminal Miscellaneous Application is received from the court of Honorable Sessions Judge Ghotki for disposal according to law. The applicant is present along with his counsel. The ADPP for the State is also present and waived the notice. Arguments heard. Order passed and announced. The learned counsel at the very outset submitted that he will be satisfied if SSP Ghotki at Mirpur Mathelo is directed to redress applicant???s grievances through impartial enquiry by an honest gazetted police officer, to which the learned ADPP for State concented with submission that police authorities are bound to proceed in accordance with law and Police Rules. It is worth observing that a Circular No.AIGP/Legal/LC/CPO/2957-64 dated:14-4-2026 has been issued by office of IGP Sindh Karachi directing all SSPs, SHOs and other concerned police officers to ensure that FIRs in cognizable cases be lodged strictly in accordance with section 154 Cr.P.C and in case of deviation from the afore mentioned instruction the matter shall viewed seriously and appropriate disciplinary action shall be taken against the concerned officer(s) under the relevant laws and rules. The leanred ADPP for State submitted that SHO/In-Charge duty officer by law is bound to record applicant???s statement in terms of section 154 of 155 Cr.P.C, whenever situation be. Consequently, I feel no hesitation to dispose of instant application with direction to SSP Ghotki at Mirpur Mathelo to ensure that an impartial enquiry into the matter be get conducted by an honest gazetted police officer obviously after hearing the parties strictly in accordeance with law so that penal action i-e registration of FIR against a person at fault may be taken under compliance report within a month. Reliance in this regard is respectfully placed on an un-repoerted order dated:09-7-2024 passed in Crl.Misc.A No.987/2023 by the Honourable High Court of Sindh Karachi and another un-reported order dated:28-11-2022 passed in Cr.M.A No.S-341/2022 by the Honourable High Court of Sindh, Circuit Court Hyderabad. Let copy of this order be communicated to SSP Ghotki at Mirpur Mathelo for record and compliance subject to law and Police Rules. |
