Criminal Miscellaneous Application is received from the court of Honorable Sessions Judge Ghotki for disposal according to law. The applicant is present along with his counsel. The ADPP for the State is also present and waived the notice. Arguments heard. Order passed and announced. Per case of Younis Abbas versus Additional Sessions Judge Chakwal & others PLD 2016 SC-581 the Honourable Apex Court laid down a guideline that an Ex; Officio Justice of Peace must satisfy himself that sufficient material is available on record such as an application to Police officers to show that the aggrieved person before invoking the powers of Ex; Officio Justice of Peace had recourse to the high-ups in the Police hierarchy. Consequently, I dispose of application with direction to applicant to address a proper complaint to SSP Ghotki at Mirpur Mathelo who certainly will get it probed by an honest gazette police officer in order to ascertain real facts and to take strict legal action against a person at fault subject to law and Police Rules. Reliance in this regard is respectfully placed on an un-reported order dated:09-7-2024 passed in Crl.M.A No.987/2023 by the Honourable High Court of Sindh Karachi and another un-reported order dated:28-11-2022 passed in Crl.Misc.A No.S-341/2022 by the Honourable High Court of Sindh, Circuit Court Hyderabad. Let copy of this order be communicated to SSP Ghotki at Mirpur Mathelo for expeditious compliance within a reasonable time. |
