Certified true copy of Judgment and decree dated 12.08.2025 passed in Civil Appeal No.198/2024 along with R & Ps received from the Court of Honourable Additional District Judge-II, Sanghar, whereby civil appeal has been allowed and Judgment and decree passed by this Court has been set-aside and suit of the plaintiff has been decreed with direction that plaintiff shall be entitled to receive compensation equivalent to the prevailing market value of the land under possession of each defendant, such value to be determined by the learned trial Curt. Needless to mention here that the trial Court may appoint commission for determination of market value of suit land of each defendant if needed. Upon payment of the compensation by the respective defendants, the plaintiffs shall execute registered sale deed in their favour. However in the event that any defendant fails to deposit the market value of the property as determined by the learned trial Court within three months , the plaintiffs shall be entitled to recover vacant possession of the portion of the suit land in possession of such defaulting defendants.
