AD KDA commercial land dpt. submitted report therein stated that the suit property LS-283, Sector 11-E does pertains to us. Order passed thereon, filed. Counsel for the plaintiff filed an application U/O 18 rule 18 CPC. Order passed thereon. In order to save the interest of parties and to secure the ends of justice, I do not feel any harm to appoint Nazir of this Court as Commissioner to ascertain the actual position of suit property bearing House No.LS-283, Sector 11-E, North Karachi, Karachi, ad-measuring 83 square yards, in presence of officials of KDA, SBCA, KMC, SKAA departments. The Nazir shall prepare such report and submit the same before this Court on or before next date of hearing alongwith copies of relevant documents, if any. The Commissioner fee of Rs.15,000/= shall be paid by Plaintiff within seven(07) days hereof. Plaintiff and his Advocate are required to present at the time of inspection of suit property and no separate notice is required to be issued by the Nazir in this respect. The application in hand stands disposed of accordingly. Office is directed to issue letter to AD KDA residential regarding current status of suit property House No. 103/5, Sector 11-D, New Karachi whereas the report with suit property No. 3 i.e House No. 49/4, already available in the file and entered on the name of deceased. Put off to 24.10.2025 for compliance. |
